Indeed, so we agree. And agree that copyright needs to be respected (and, beyond all, it should be respected morally).
E.g. one of the supposed mistakes was that according to Spender the license in grsecurity/Makefile covers the entire directory.

So upstreaming files in that subdirectory without somehow magically knowing that amounts to removing copyright notices according to him.

Of course, *nobody else thinks a Makefile is a reasonable place to put a copyright statement that should apply to the whole directory*.
