If someone plays through an entire game and decides they didn't enjoy it and want a refund, I think that's actually OK.
If someone plans to fraudulently return a game after they're done, that's wrong/unethical, but different from piracy.

There are finer points that make it undesirable to equate it with piracy. E.g. inability to replay, non-anonymity.

OTOH if someone buys a DRM-free game, immediately returns it, keeps playing, then yeah, that's pretty much piracy.
