Ignoring things that are wrong and hurt people is how we ended up with the police brutality in the US. It's how we ended up with a sexual harassment problem in the chiptune scene, and people feeling unwelcome. You don't fix problems by looking the other way.

He's losing some viewers, but he's also getting and cultivating a community of viewers that *don't* care about this stuff. That creates a self-reinforcing echo chamber that makes him think everything he does is okay.

You seem to be confused about how laws work. "Being above the law" means being allowed to break laws. What we're talking about here is being better than laws. That is actually a requirement for civil society. What the law requires is a bare minimum, not a target.
