(I remember that some earlier models had closed source firmware for a hardware codec chip because of patent reasons...)

Probably because it's still VideoCore code which doesn't have a usable open SDK/toolchain, same reason the boot blob was closed source on the previous Pis?

No Raspberry Pi ever has had an open source bootloader as far as I know, for this reason. Because the GPU firmware *is* the bootloader, and the GPU is the main CPU, and Linux really just runs on an oversized coprocessor.
