This isn't considering IR leakage from DPSS green lasers though, which is a totally different problem that has nothing to do with the sensitivity of the retina. That just depends on how crappy the laser pointer is.
But yeah, nobody should be selling >5mW pointers as toys. That's just negligent. They are useful tools and they should be available to the public, but always in the right setting and with the right documentation, definitely not a "street merchant".
