If Admin. is going to seek cert b4 judgment in SCt, it must first have an appeal pending in 9th CA. That's the rule.

One can only go direct to SCt from a DCt under normal appeals if there is pending an appeal in CA first. Does not mean CA will revu first.

Ok I think I get it now -- DOJ filing will be styled as motion to clarify injunction or, in the alternative, cert. b4 judgment
