Earthbound was in kind of a legal gray area at its release due to referential stuff as I understand it and I imagine similar might be the case if re-released now? They're probably too scared to risk the hassle. As for Mario rpg that's probably a Square-Enix related hassle.

I would expect SE to port Mario rpg to switch at some point in the ways they brought over mobile versions of Dragon Quest to avoid localizing Dragon Warrior.
