    But the head of Corcoran, one of the largest brokerage firms in New York, emailed this to staff: "Until further notice, we recommend continuing to conduct your business in accordance with the law and all applicable regulations, not advisory opinions promulgated in haste.”

    The State said that the changes are NOT retroactive, meaning that renters are not eligible to refunds if they rented an apartment after the passage of the new rent laws in June 2019.

    NEW: Renters are no longer required to pay fees to brokers hired by landlords, but everyone is still confused over what happens next. One of NY's largest brokerage firms wrote an email to staff saying not to abide by the new guidance. W/ :

    Erin McCarthy, a spokeswoman for New York’s Department of State, said the guidance applied only to future rentals. “This is not intended to apply retroactively and future transactions should be entered into with this guidance in mind,” she said.

    We heard from dozens of renters asking whether the broker fee changes are retroactive, whether they can get a refund if they rented an apartment after the June rent laws. The State just confirmed the changes are NOT retroactive. More to come shortly.

    I must say... I covered the new rent laws last year and I never heard lawmakers say they intended to specifically eliminate broker fees. Six months + later, it turns out the bill language was vague enough for regulators to interpret it that way -- real estate's greatest fear.

    This is huge news. I’m surprised this was passed with virtually no public debate. I hate broker fees as much as the next person. But I do wonder about the implications...

    This could upend the business model of New York's brokerage firms, which employ thousands of real estate brokers. It will effectively transform the rental market into a "no-fee" market for renters.

    Landlords could raise the rents of market-rate units to cover the cost of broker fees. But they won't be able to do so for NYC's almost 1 million regulated apartments. Rent increases for those units are set by the government.

    This guidance from regulators aims to clarify the new rent laws Democrats passed in Albany last June. Lawmakers imposed a $20 cap on fees tenants could be charged when applying for an apartment, like background checks. That cap, the state says, also applies to broker fees.

    Brokers are still allowed to collect broker fees from landlords, not tenants. The real estate industry argues landlords will just pass on the cost to tenants in the form of higher rents. Real estate is likely to challenge this in court.
