(I disagree. :-D I don't hold up current European framework as ideal though I understand the historical differences fairly well on where they end up... And there are more listener-centered theories of censorship in US jurisprudence which mine kinda is. But we need this debate)

If you consider that the mechanisms required are not the regulation of speech, but rather the regulation of business practices, you'll see more useful--and less intrusive--scenarios for intervention in social media. Yes, there are obvious free speech implications here, too...

... That's kind of the point. But it's protection of speech from obvious malice. Nobody can reasonably argue for inaction based on current evidence. But a more useful vein of legal exploration is antitrust law. We can and should be questioning Facebook's scale ....
