    You are deeply confused, Mr. Fitton. The Constitution gives Congress the duty to set the "time" for the appointment of electors. Congress did that (3 USC 1): November 3. No state has the power now to select a new slate.

    Faithless legislatures are as wrong after Chiafalo as faithless electors: the rule now (whatever it was originally) is, as Justice Kagan put it, “here, We the people rule.”

    Yes — Clinton had won the popular vote, and I argued that justified electors in switching their vote for her. BUT: (1) Trump has not won the popular vote, and (2) when I took this idea to the SCT, they said electors had no right to go against the popular vote.
