Fewer than 5% of criminal cases see a jury or bench trial. The remainder are pleas. The outcomes, therefore, are the negotiated deals between the prosecuting office and defense counsel.

ok, but thats not what the article is talking about, its talking about cases where charges were brought against the defendant. I hope that clears things up.

The article, and Ms Marshall, stated charging rates are up for homicide, yet inside the article, we see: “Charging rates for some case types have not changed under Boudin…his office’s rate for homicide cases is 75%, virtually the same as the 73% rate of Gascón…which is it?

A two percent increase in homicide charging is not the “significant” increase Ms Marshall states it is. Nor does a case end at “charging”. It ends with dispositions, the information about which is notoriously difficult to glean from the DA’s office.
