THREAD: Prosecutors can play an important role in holding police accountable. @JoyWhiteVance made this case in a piece for @TIME yesterday. https://time.com/5863783/prosecutors-criminal-justice-reform/ …

Prosecutors have a responsibility to hold the cases they prosecute to strict Constitutional standards. Failing to do so is an affront both to the justice system and to the communities they serve.

The @BrennanCenter has written extensively about some of the themes Vance highlighted in her piece, namely, the rise of the “progressive prosecutor” and the steps prosecutors can take to help reform the system. We recently collaborated with @nyucrimlawhttps://www.brennancenter.org/our-work/research-reports/reimagining-prosecutors-role-sentencing …

Vance writes that, while prosecutors word hand-in-hand with LE, they must also “be unambiguously committed to using constitutional standards to evaluate that work.”

In our 2018 report with @fjp_fairandjust @miriamkrinsky @Justice_Collab, we argued that investigations & prosecutions of LE should be safeguarded by procedures focused on ensuring independence, impartiality, & transparency, + use of second-look review.https://www.brennancenter.org/our-work/policy-solutions/21-principles-21st-century-prosecutor …

Beyond holding LE accountable, DAs can, and should, use their broad discretion to institute reforms both within their office and within the broader CJ system. Vance lifted up two key examples that I want to highlight below:

In addition to reforming sentencing practices, @DA_LarryKrasner has created a task force to investigate reports of police misconduct during the #GeorgeFloyd protests. https://www.phillyvoice.com/larrry-krasner-task-force-investigate-protesters-arrests-philadelphia-district-attorney/ …

.@chesaboudin is refusing to prosecute or charge cases that are based solely on the testimony of LE officers with serious misconduct records.https://sanfrancisco.cbslocal.com/2020/06/16/da-chesa-boudin-not-charging-cases-sfpd-officers-misconduct-history/ …

Not in Vance's article, but last fall @BrooklynDA publicly released a list of NYPD officers with credibility issues + some police that the office will not use as the only witness in a criminal case.https://www.nydailynews.com/new-york/nyc-crime/ny-brooklyn-da-releases-list-of-cops-with-credibility-problems-20191107-nc546s2xuvbzvpypnautt6rkeq-story.html …

More prosecutors need to hold LE accountable when it is clear that justice hasn’t been served, and they need to commit to reviewing and reopening cases, when necessary.
