Not quite. 3/5 is not really a deadline but for different reasons. Many #DACA recipients have already lost protections and work authorization. Court ruling allows them to reapply but apps take months to adjudicate. In the meantime, they can't legally work and could be detained

#DACA recipients, even before the decision to end the program, was to apply 150-120 days in advance of expiration date. The USCIS processing goal was 120 days. -
Correct me if I'm wrong: b/c of court ruling, people whose DACA status expires AFTER March 5 would be able to reapply, which would not otherwise be the case (unless something else changes before then). It was always an arbitrary date

They can reapply but Dave's point (correct me if I'm wrong) is that while it takes the ~120 days to approve a renewal, the DACA recipients would be left vulnerable in the meantime

right but it does mean that those whose status expires up to 120 days AFTER March 5 have an opening to reapply without losing their protections, no?

Right now, under the court ruling, all previously-approved DACA recipients may apply for a 2-yr extension -- no new applications. Those w/post-March 5 expiration dates can now apply for renewal, but court -- or legislative -- action could change that so uncertainty remains

But post March 5, if SCOTUS reverses district ruling DACA ends immediately right? Doesn’t restart a clock?

Ends immediately which is why they need to fix it now.

And if there are 5 votes at conference on 2/16 the lower court ruling can be stayed? And then March 5 is the deadline date again? [Not a lawyer...]

Bottom line, It’s better to have it in place before March 5. If court overturns (likely) near or after March 5, all DACA protections vanish. So March 5th is a deadline.

DACA is NOT accepting new applications and they are not processing advanced parole requests. So, not really fully effective.
