Kennedy said he was wary of paving the way to businesses denying service in a way that would be "an affront to the gay community." But then he said the Colorado civil rights commission showed "hostility to religion"

Here's the case. The guy applied for a business license in his jurisdiction. He agreed to the anti discrimination aspect of the license when he signed the application. Did he discriminate. Yes. Case closed. And his license should be revoked. Plain and simple. An artist, pffft
-
You may mock Philips as an artist, but first I challenge you to make a wedding cake to serve 300 and have it be half as beautiful as one of his. This isn’t about his skills.
-
And subway calls its employees sandwich artists. That doesn’t mean that the guy behind the counter can deny me a sandwich.

I’d like to move back to America now. Does anyone know where it went?
-
I suspect it was always a ruse....
-
This has been it for its entire existence except that it's a bit better than it used to be.
-
I'd argue it was a bit better, for a while, from the late 70s ish through the early 90s and then went downhill fast. A certain kind of conservative aged up and turned more sour than they already were. It's definitely worse than it was then.

Even if that were true, what bearing does it have on the constitutionality of the Colorado law? Lots of laws don't bother lots of people, doesn't mean they are or are not constitutional.
-
To be honest, I was commenting on the hypocrisy of what I personally find to be discrimination. I find 1st Amendment to be freedom to practice religion, not publicly discriminate based on it. I served my country for equal freedom for ALL.

-
Ah, sorry I misread it as being an argument about the merits of the case rather than the merits of hypocrisy
-
Well..can it not be both? (btw and off subject .cranky old dog lover also)
-
I'm not sure that people's hypocrisy really effects constitutionality (unless it's judges, which is a whole other rant!) On the aside... lets be real, puppies are cute, but cranky old dogs are the best!

-
But there is the interpretation of religious freedom involved and how it affects public opinion and policy of businesses across the country.
#SystemicIgnorance.#ReligiousFreedom#equality#cake -
Definitely. My totally uneducated guess is that it will go for Philips, but that they will try to make it as narrow as possible. I spent days on SCOTUSblog ploughing through some of the amicus briefs and ended up at
