Exactly, and abortion cases (particularly putative class actions) are a classic example of where this doctrine applies.

IF the gov would take a position on the underlying question, I could see the Court taking it.

I think at this point the case will get sent back down and ultimately the DHS rule will be enjoined. Unsure if the Court would grant cert.

It seems to me to be a pretty clear violation of Whole Women's Health and Casey, they may not feel the need.
