The rule is question is actually supported by some business interests, including Honeywell, but was challenged by other companies that want to use HFCs more broadly

In its brief, the Trump administration notes that the EPA now basically agrees with Kavanaugh: "The agency now believes that the decision below reflects the better understanding of Section 612(c)."

As article stated, EPA will soon be changing the reg anyway, so it would be a waste of court’s time to hear the case.

The point is, Kavanaugh showed exactly where he stands on this, and he is now on SCOTUS. It's not what becomes of the case.
