    But it is still concerning to hear that terminology, given the growing conservative push (including in the current administration) to roll back birth control access. I’d want clarification from him, if I were in this hearing!

    The generous interpretation of this comment is that he was describing the plaintiffs’ case — they (incorrectly) consider IUDs an abortifacient.

    Kavanaugh: “They said filling out the form would make them complicit in the provision of the abortion-inducing drugs that they...objected to.” The case he’s referring to was about the birth control mandate. Birth control =/= abortifacients.

    I've spoken to multiple women who made allegations against Kozinski and many former clerks. They and others find it implausible that Kavanaugh would never heard about Kozinski' conduct, given what an open secret it was. But no direct evidence he knew.
