HHS’s : “We will pursue the goal of patient empowerment... patients need & deserve access to their own health records. Scare tactics are not going to stop the reforms we need.” Mic drop.

. has been trying to get a copy of his health record for a month and can’t get his call returned. At the annual meeting, he advocated for personal control of health data, interoperability, and preventing information blocking,

Great to hear discussing digital credentials during the meeting which the has been advocating for since 2017. In the , we will develop consensus on the principles we need to federate that identity across systems in 2020.

In a opinion essay I wrote with we ask Epic to stop its aggressive campaign opposing interoperability and to not block patients' rights to computable copies of their health data.

3/7 Consider what would happen if the 21C Cures mandated API worked like US Mail, or Fax, or secure email. (1) Patients, not data brokers, would decide who has access to the API. (2) Patients, not data brokers, would judge the privacy practices. Real competition not paternalism.

Should HHS finalize the interoperability and data blocking rules as proposed, requiring that EHRs give patients access to their own data through APIs? [Reply with more details appreciated]

Hands down, without question yes. THESE rules WILL save lives and change consumer experiences with healthcare forever. There is no argument against that justifies not finalizing the rule. I believe your poll agrees.

Do I get two comments? This one comes to mind: Today, an individual could get a copy of their PHI, hand enter it into an app outside , and be just as unprotected from that app as they will be when ONC”s rule is finalized, absent Congressional action on .

What said. And the right is more than to just “access” (look at) their data. The right also is to copies of that data, and which patients can then use and share as they want. Portals don’t facilitate that; APIs will.

Yes. HIPAA already established the legal right for patients to access their health information. APIs make it practical and easy for patients to do so in practice.

As we duke it out about whether patients should get access to their medical record this week, a reminder of Leila’s experience: “I've got two medical experts who disagree, but they can't even share a CT scan between two different hospitals down the street from each other."

The ONC & CMS rules are officially LATE. OMB has 90 days to review regs w/ a 30 day extension possible. At the earliest they come out Monday. That’s 124 days for CMS (submitted 9/26) & 92 days for ONC (submitted 10/28). Unclear if either got an extension; CMS overdue regardless
