My take is few people know it’s happening and many who do will forget. Bummer tho.

We need to set reasonable and clear rules on what the Coastal Commission can and can not do. How to balance property rights and coastal access. This should really be a class action to clarify many legal issues that are unclear and arbitrary.

The Greenwich case was about a public authority (Town of Greenwich) prohibiting access to some members of the public (non-residents). The Khosla case is about forcing private property owners to allow public access across their property. Not the same.

This is the weakest part of his case. Any “taking” occurred when coastal rules came into force—before Khosla bought the property. Any smart purchaser would’ve factored that impairment into purchase price.
