Assume, for the sake of argument, that all of the bad things the govt asserts about China are true, do we want to give unilateral authority to the govt to destroy companies? What does that portend for US companies operating in foreign jurisdictions?https://techcrunch.com/2020/08/02/pompeo-says-u-s-may-take-action-against-tiktok-and-other-chinese-tech-companies-shortly/ …

I’ve basically thought some confrontation like this would happen for at least a year and a half? I just didn’t know what method or legal pathway/precedent would be used. Moving by executive decree is deeply worrying to say the least.... see March 2019:https://twitter.com/kimmaicutler/status/1111318607257047041?s=21 …

So 1) I think the precedent was set by China (Uber / Didi most recently) and this is tit for tat and 2) I do believe that split web is somewhat inevitable, just EU has been incompetent in building viable alternatives and just keeps fining/regulating US tech instead

Are you suggesting that we duplicate the practices of an authoritarian country because they did it to us first?

Forget other countries for a minute. It also gives our own country a precedent I don’t personally want.

Was it always the case that countries can prevent M&As threatening their sovereignty? The TikTok case sounds more like specific retaliation against the lack of separation in China as well as lopsided constraints on foreign companies (eg IP/copyright/corp structure).

IThe way a Chinese company operates is very different from the way a US company operates. This move only sets precedent for banning companies who operate in a specific way (ie having no choice but to share sensitive user data with a foreign authoritatian govt)

If I were a European AOC I would use this as a precedent to call for a EU purchase of the European operations of US big tech
-
If I were a US Tech company, I would just say no and let them try to pull our companies from the EU. And then watch how quickly the US applies pressure on them to back down. This is geopolitical, and the US has the power

I think the solution to that is to make it clear that it only applies to the PRC and is for lack of reciprocity then.
