Here's the prob.: CA has for 40 years required local govts to periodically analyze "govt constraints" to housing dev., and remove constraints "where appropriate and legally feasible." The analysis is s/t review & approval by a state agency. System doesn't work real well... 2/9

Why not? We posit that part of problem is lack of normative guidance from state leg about what's an illegit constraint; even bigger problem is asymmetric info (lack of data for pinpointing local constraints) + substitutability of constraints. 3/9

Re information: leg has established timeframes for project review (PSA), including enviro review (CEQA), but state housing agency doesn't ask and local govt's don't say whether they're complying. Probably b/c local project tracking systems don't enable one to say... 4/9

Solutions? We propose two-track approach. Track 1: classify local govts as "presumptively constrained" if their rank by rate of housing growth is lower than rank by fair-market rents. Latter is proxy for "locally unconstrained feasible units"--production w/o constraint. 5/9

Local govts deemed presumptively constrained would have to provide regulatory waivers to developers trying to build on sites local govt has represented as "available," if developer shows it's impractical to build # units local govt said site could accommodate. 6/9
