It is not as if UCs isnt actively practicing AA despite there is a ban on it.

Constitutionally, the Bakke case — decided at the SCOTUS level — lets systems weigh race among many other factors. Ironically, it was Republicans not Democrats who first instantiated hard quotas w the Philadelphia plan in the 1970s.
