      Judge is grilling an attorney for the Howard Jarvis Taxpayers Association; will not consider with the June Prop. C was a "stalking horse" measure -- developed jointly with the public and the Board of Supervisors.

      That's important -- it gets to the heart of the issue, that govt's attempting to pass special taxes require a 2/3 majority to pass. Local measures (developed by citizens) require only a simple majority.

      We're on a 15-minute break. Deputy City Attorney Wayne Snodgrass rebutted the HJTA arguments. Much of it was deep in the weeds, but much of this dispute turns on the concept of "collusion." (I know I know.) (cont'd)

      HJTA is worried that, with a simple maj. threshold government officials will be invited to "collude" with citizens groups to raise taxes for specific purposes. Petitions to raise taxes brought by citizens need only a simple maj. to pass. Those brought by the gov need 2/3rds

      But the city argues it's not right to construct barriers between government officials and their citizens. Snodgrass: "What we’re talking about is a real erosion, an undermining, of the idea that the initiative process is to be liberally construed."

      Worth noting how many childcare/education and homelessness advocates came today. Most have to wait outside the courtroom. They came to watch an extremely dry, technical argument because these are important issues they care about. As the judge said "This is a very political city."

      Hearing has ended. Just as it did, the judge said he's ready to rule as early as *this afternoon,* or probably Friday at the latest. He has 90 days, but isn't going to need them, he said.

          Yeah, three years is the generally agreed-upon timeline. Given the virtually unlimited resources both sides have to throw at this, either one will very likely appeal. Not outlandish to think the state Supreme Court will have to ultimately sort it out. Hence the long wait.
