Well, it would be if they made good on their promise and they wanted to avoid litigation. And if it wasn't all or nothing. So it'd be a charge for each unit of affordable housing you don't build. Plus, exclusionary affordable housing (built on more than 1 on 1 ratio)

I imagine: Developer builds true TOD with specifications we want. Developer gets financed by gov't (they get a payday) in exchange for making them quasi-market rate (with max income). We greatly expedite the process but leave locals in control of final approval.
