In practice, recognizing the need for new/modifies rules is the easiest part. The tough thing is figuring out how to write a rule that solves the problem while a) controlling for unintended consequences and b) being something that 10k people can do consistently.

It’s not an either-or thing - clearly both are problems. But, as a rule, external dialog on this stuff tends to over-emphasize “they didn’t see it coming” and underemphasize “they don’t know how to reliably do a sufficient solution”.
