    The decision makes clear the limitations of the agreement being requested. It does not grant anyone immunity from prosecution.

    Sir Martin Moore Bick will only ask for an agreement of this kind to cover Modules 1,2 and 3 of Phase 2 - these cover the refurbishment of the tower, material testing and marketing, and complaints and communications with residents during the refurbishment

    Sir Martin Moore Bick is approaching the attorney general to ask for oral evidence given in the inquiry to be excluded from future prosecutions against those giving it. The public Inquiry won't sit again before a decision has been made - 24th February, at the earliest.

    Lead counsel to the inquiry says he opposes the timing of the request, but says requesting an agreement is in the public interest - "without it you will not get to the truth"

    One of the lawyers who made the application argues that if an agreement is not made the inquiry will regularly have to pause to explain legal rights to each witness who appears at the inquiry & consider whether they should answer individual questions. This would be disruptive.

    Stephanie Barwise who represents a different group of BSRs talks about the timing of the application saying it "bears all the hallmarks of sabotage of this inquiry" - all the companies knew about the risk of future prosecutions a long time ago.

    The request made has previously been granted in a number of recent public inquiries including the Stephen Lawrence Inquiry, Bloody Sunday Inquiry, Ladbroke Grove Inquiry, Baha Mousa Inquiry, Al Sweady Inquiry, Azelle Rodney Inquiry, Undercover Policing Inquiry.

    This privilege is described in the Inquiries Act, which states ‘It is the right of a person in any legal proceedings other than criminal proceedings to refuse to answer any question or produce any document...if to do so would...expose that person to proceedings for an offence’.

    As I understand it he’s been asked to request that the attorney general exclude evidence given at the inquiry from future prosecutions. He’s going to receive proposals about this submission tomorrow afternoon
