Uber just lost its motion for a preliminary injunction against AB5 enforcement — this means the law can be enforced while Uber sues to overturn it.
reading through the judge's ruling now, which picks apart Uber's (and Postmates') arguments: - judge says gig economy was singled out by lawmakers - gig workers aren't deprived of pursuing their chosen occupation - no irreparable harm to the gig companies
when your entire argument for your lawsuit, ballot measure and brand is FLEXIBILITY, your expert should not say "flexibility is nbd"

Good to see. Also I honestly wonder how many hundreds of thousands of gig workers in California are being paid below min wage. I wish we had good data on this. I think it is a huge number.
Every single one who is doing 40 hours or more.
My control test argument against AB5, “Typically employees are not allowed to work for direct competitors. Uber/Lyft/Postmates/DoorDash drivers often do so at exactly the same time.”
I'm sure #Uber will appeal all the way to SCOTUS. Not bc of costs related to W2 status, but bc as employees the companies are liable for accidents, assults, negligence which their biz model cannot sustain. As IC every rider under forced arbitration, same as drivers.
My prediction is that a Uber in CAlifornia either lets the driver determine prices for a ride or lets the rider offer a price and driver can choose to accept or not. Without Uber determined pricing, the argument that Uber has control over drivers doesn’t work anymore.
