Thank you Congressman 1) Courts have upheld executive action based upon the War Powers Resolution 2) Resolution gives executive 48 hours to notify Congress. 3) is this a 'war' or just a proportional response?https://youtu.be/rtrX9rZl-j4

You’re going to hear and read the false, tired assertion that the War Powers Resolution (or Act) allows the president to take offensive military action without congressional approval for 60-90 days. Here’s why that’s not true:

Statute cannot limit President’s Article II power as Commander in Chief. War Powers Resolution is an unconstitutional attempt to do that.

Statute most certainly limits presidents action - if this turns out to be more than a strike(s) - its clear the executives power is limited w/o Congressional approval.

Where is it clear, in an unconstitutional statute?

Read section c. https://www.law.cornell.edu/uscode/text/50/1541 … - again courts have upheld 'offensive' military strikes before

You seem to be missing the point. A statute cannot limit a President’s Article II power. He has that power by the Constitution and only a constitutional amendment can limit it. The statute you cite is moot, it is an attempt to do what the Constitution does not allow.

And we agree on Article II powers - Article I, Section 8, Clause 11 of the U.S. Constitution grants Congress the power to declare war. The President, meanwhile, derives the power to direct the military after a Congressional declaration of war from Article II, Section 2.

There is nothing in the Constitution making Art II CinC power contingent on congressional action or approval.

In declaring war yes there is, read the clause I stated to you. For actions like tonights, courts have upheld the executives action in the past as in the case of Kosovo in 1999 https://caselaw.findlaw.com/us-dc-circuit/1177126.html … 1/

I agree with you on the War Powers Resolution however, in prior cases as in Clinton's Kosovo attack in 1999, courts have upheld the 'offensive' military actionhttps://caselaw.findlaw.com/us-dc-circuit/1177126.html …
