        What about the separation of powers? Congress barring chief executives from firing subordinates seems like a significant encroachment. I think if the only constitutional remedy would be impeachment.

        not quite seeing how the only person who could fire the special counsel is deputy AG for cause. The special counsel is not a subordinate of executive branch. We must protect the independence of the judiciary.

        The AG's office is part of the executive branch, and the special counsel exercises executive powers, the entirety of which is vested in the executive branch I don't see how any legislation can constitutionally usurp executive power without encroaching on the separation of powers

        Sorry AG is part of executive branch. I meant DOJ. Still does not change the fact that AG is the only one who holds the executive power to remove SC once appointed.

        If the exec power is delegated to the AGO due to legislation (as I believe it currently is) then it's constitutionally dubious. If it's delegated by the chief executive then it can be revoked. But I'm sure the threat of impeachment likely makes the constitutional question moot.

        It would surely be a hollow victory for any chief executive to challenge the special prosecutor legislation and be constiutionally vindicated only to be impeached thereafter. At a minimum it cld only be done by a pres with his own party firmly standing behind him (ie. not Trump)

        Well considering the line of question from Rs in oversight hearing, I don't think it's so far fetched. As for now, i see it more of a ploy to discredit investigation which is just as harmful as removal. Lindsey Graham now wants to appoint a special counsel into Hillary Clinton 😆
