Yes, but at what point do you look to recent history & context and determine that speech is likely to be violent, surpassing 1A protections?

-
Exceptions for incitement of violence and "fighting words" are very narrow. As they should be. SC doesn't recognize "hate speech" as a thing
-
I'm aware. I passed the bar exam last year. But at what point do you look at history to determine whether speech will be incitement?
-
After this weekend, it feels much safer to say that the next protest between these parties will be violent, regardless of gov. intervention.
-
The correct way to deal with shitty ideas is to let them see the light of day and fight them with better arguments.

Hate speech, too, is an exercise of free speech.
-
so you do hate speech to your kids, too? as an exercice for intellectual training for free speech? BS hate speech = verbal violence
-
"Hate speech" is a term concocted by those who have contempt for *free* speech.
-
You did not answer: you do this kind of speech to your kids??? No limits to nothing?

And how do we fight armed terrorists in our streets when our police stand down?
-
Police were outgunned
-
Sounds like they should've called in the National Guard...or done whatever they would've done if the occupying force had had brown skin.
-
Exactly. Tanks, water guns, rubber bullets...these white frat nazi dudes were left to roam free.

I really feel like the court has erred on hate marches. Nazi flags carried by armed men are not protected by the 1st amendment
-
Except they are.

How do you argue with someone who thinks you shouldn't exist and is holding a gun?

So the Jews in WWII Germany would have been fine if they would have just defended themselves?
