This is SCOTUS discussing the fact that it, like other branches, needs to interpret Constitution to carry out a function (resolving a case).

And the situation would remain until judicial review? which basically means until a new whim strikes. There is no check on power there.
-
Situation you describe is possible under either view. Tyrants don't care about laws. But your view requires a good pres to violate Const'n.
-
Is he? If he interprets murder to be unconstitutional it should be good right?
-
Under your view he's fine till a court tells him he's wrong or Congress makes another law.. at which time.. at whim ..new interpretation.
-
Pres executes laws. Constitution is supreme law. He swears oath to uphold it. When it conflicts w/ other laws, he must follow Constitution.
-
Off to dinner. I disagree with how you have presented your position. Perhaps I've misunderstood. But I just don't see your position at all
-
President faces political consequences if his actions are not justified. As I've noted, neither view will constrain a tyrant. Take care.

I'll look more into this Kate's law, still believe sanctuary cities are hurting us. Glad to see you don't support Obama/trump care.

There also ought to be consequences for wrongful suspensions. Soldiers face charges if they refuse an order and their interp is wrong.

You make room for a petty tyrant to decide what laws apply and to whom at their whim. A complaint we had against King George, and Parliament

I disagree there. I don't want 'The Purge' to be a thing just because someone decide , meh screw enforcing murder laws.

There is an obligation to uphold the law. I agree with suspension pending review; but not arbitrary suspensions

Cromwell overturned the Monarchy and his own Republic over that arbitrary enforcement of law
