It doesn't need a replacement. Health care did fine for years without govt.

Where did slavery fall in terms of the 10th amendment? It seems it should still be around if the 10th were an inviolable concept?

It was until overridden by the 13th, which is why the 13th was necessary.

10th says if not in constitution then it's a state issue. The 13th put slavery explicitly in the constitution.
