Must executive follow 50-year old SCOTUS interpretation if current composition of court would likely decide differently?
-
@alllibertynews@justinamash No. The Executive choosing what to enforce and what to ignore is that branch's check and balance.

Either you are talking a language I don't understand or you are explaining someone else's govt. SC is only body that determines
-
SC decides disputes over Constitutionality when they arise. Keyword disputes. They don't vet all laws/actions.
-
That is right, but only as a result of this are laws ruled unconstitutional, other branches do not determine this

Congress and President have a solemn duty to only pass and execute laws
-
Amash said they get to decide if they are constitutional, wrong.
-
They do decide. Every day. They just don't have final word.

They do not decide every day, a law is not ruled unconstitutional until the SC rules that way.

You're splitting hairs.
