I'll ask again - at what point does a law become unconstitutional?
-
-
-
Each branch has an independent duty to interpret and uphold the Constitution.
-
Please answer my question.
-
Sorry for any misunderstanding. An unconstitutional law is unconstitutional the moment it is enacted. No court opinion required.
-
Sorry - but I strongly disagree - courts decide this after a law is enacted - your position is dangerous to the rule of law
-
No, you are not correct. We swear an oath to support and defend the Constitution. This is precisely how the Framers designed it.
-
Courts simply interpret Constitution and laws in course of deciding particular cases between specific parties.
-
So we get our own interpretation as to what is Constitutional & we can go by what we believe over the court's interpretation?

he's generated/supported countless bills w/ his 1 HoR vote, what magic powers do you believe Reps have besides that? /
@justinamash -
you're yelling at the *hands-down* best House Rep on either side to "do something", when he's literally doing all he can already.

So a President also has authority to deem what is and isn't Constitutional?

I'm pretty sure Jefferson wrote about this extensively, the duty of legislators. Funny how old becomes new again.
