        The President does not determine what is constitutional, the COURTS do. Pretty sad that a member of Congress doesn't know that.

        If it's a federal law, isn't it constitutional until declared otherwise by SCOTUS? That's the system of checks and balances-no?

        "Judicial Review" appears nowhere in the Constitution. It was created by John Marshall, decades later.

        But SCOTUS has weighed in and held that regulations are constitutional. President can't override that.

        Regs are exec acts and can be reversed by exec branch, just as statutes can be repealed by leg branch
