if different states choose to keep different programs, how is that equal protection under the law?

e.g. Lets say one state does keep Title IX & another does not how are citizens getting equal protection?

States may have different laws under our Constitution, but they may not violate or ignore constitutional requirements.

I worry some states will have stronger laws than other states. Before civil rights act, lots of diversity in laws.
