Eliminating a federal department does not take away constitutional protections. The Constitution doesn't work that way.

The 14th Amendment authorizes Congress to pass appropriate legislation; that's why the Civil Rights Act was rightly passed.

Q. about bill to eliminate Dept of Ed: What happens to Fed programs like loans/grants, Title IX, IDEA, ADA? Who oversees?

They can become state programs if desired. The federal government would continue to enforce constitutional safeguards.

e.g. Lets say one state does keep Title IX & another does not how are citizens getting equal protection?

States may have different laws under our Constitution, but they may not violate or ignore constitutional requirements.

I worry some states will have stronger laws than other states. Before civil rights act, lots of diversity in laws.
