Agree so far. Isn't prosecutor's choice not to prosecute a lawbreaker = waiver of law by executive branch?

Similar if prosecutor acts based on who the person is (e.g., his friend) rather than on neutral rules considered in advance.

Concerns about legal interpretation/separation of powers make it possible to conclude it violates law but not Rule of Law.
