No and no, not as a general matter. But standards and prosecutorial discretion have potential to violate the Rule of Law.

Agree so far. Isn't prosecutor's choice not to prosecute a lawbreaker = waiver of law by executive branch?

Similar if prosecutor acts based on who the person is (e.g., his friend) rather than on neutral rules considered in advance.
