@DavidLKeating I think you're misunderstanding my point. This is a novel case. Akin's camp was running ads based on McCaskill's suggestions.
@justinamash They were ads for Akin by Akin, not by McCaskill or for her primary election. It is novel, but it's not illegal coordination.
@DavidLKeating I disagree. She admits that her actions were to benefit her campaign. I'd call it a "misdirection theory" FEC violation.
@DavidLKeating Is the law poorly written? Yes. But her actions sure seem to satisfy the three-prong test for coordination.
@justinamash @DavidLKeating It'd be helpful if you laid out how it meets the three-prong test. The threshold seems impossibly high.
@MEPFuller (1) Someone other than McCaskill paid for ad. (2) Ad advocates for a candidate. (3) Ad was distributed at McCaskill's suggestion.
@justinamash The McCaskill ads purportedly against Akin were from a PAC? She endorsed the ad, no? Also, "materially involved in decisions"?
@MEPFuller Look at the law. Doesn't have to be from PAC. She doesn't need to publicly endorse. She doesn't need to be "materially involved."
@justinamash I'm just genuinely confused what you're saying is an in-kind contribution? Is it telling Akin to run the Huckabee ad? Her ad?
