The correct question under our Constitution is: What is the authority for the legislation? We live under a Constitution that grants Congress limited, enumerated powers.

I appreciate you responding and your POV here is necessary. But, is the Constitution a living document or not? I get that it grants limited powers to the state, the Army & Navy, e.g., but not an Air Force. Is the Air Force constitutional?

Article V provides for the amendment process. Many people today believe the Constitution is “living” and seek to “amend” the Constitution outside of this process. I clearly do not subscribe to that. The Air Force was founded as part of the Army.

Our Constitution grants Congress only limited powers. Most are listed in Article I, but some are in amendments to the Constitution. This hotline is not authorized under any of these powers. Article V provides an amendment process if the people want to give Congress a new power.

Libertarians frequently use unconstitutionality as an excuse to vote against popular legislation that they oppose for policy reasons. But they are never consistent. For example, libertarians all hate the Post Office even though it is clearly constitutional.

Thats not a logical argument. If they say they hate everything unconstitutional it doesnt mean they have to be in favour of everything constitutional. Tariffs are constitutional, that doesnt mean he has to like tariffs as a policy.

Of course not, I fully agree with you. But being a legislator that has sworn to defend the constitution I dont think its unreasonable to reject legislation you believe undermine it. Plus, how easily would an amendment pass that permits feds to implement these kind of programs?

Following the Constitution strictly is like following the Bible strictly--it can't be done. The question is are your exceptions to the rules arbitrary or do they follow some logic, do you only make exceptions for your party or are you even-handed.
