Kavanaugh is not another Gorsuch—not even close. Disappointing pick, particularly with respect to his #4thAmendment record. Future decisions on the constitutionality of government surveillance of Americans will be huge. We can’t afford a rubber stamp for the executive branch.

In 2015, Kavanaugh declared “the Government’s metadata collection program is entirely consistent with the Fourth Amendment.” He cited Smith v. Maryland, a case whose facts bear almost no resemblance to the metadata program. Gorsuch recently ripped SvM in a #4thAmendment case.

Kavanaugh: “Government’s program for bulk collection of telephony metadata serves a critically important special need—preventing terrorist attacks on the United States. In my view, that critical national security need outweighs the impact on privacy occasioned by this program.”

Anyone else wondering if this is Trump’s strategy -> Nominate his 2nd pick first because left will eat up 1st pick anyway no matter who it is so then Trump will go to his preferred choice?

Possible. @POTUS certainly does things in his own way. Sometimes that is good, sometimes not so much. In this case though I think he probably does want #KavanaughSCOTUS especially for some of his views on the executive branch.

I’m sure law-enforcement will only use it in “special” cases like the War on Terror or the War on Drugs or maybe national security issues like trade deficits.

Considering you all keep passing The former patriot act now referred to as the freedom act, and NDAA with more crap undermining Americans rights that most have no clue about..it seems he’ll fit right in at least in the 4th amendment aspect

then tell all your sycophantic GOP friends in the Senate to oppose him, otherwise this is just worthless virtue signaling.

Yes that’s it. Because everyone in the GOP sits on the edge of their seat waiting for one congressman from Michigan to tell them what to do. I wish Rep Amash had that kind of influence.

Cool, thanks for explaining something that I already knew. Meanwhile, he doesn't have to convince *every* GOP Senator to vote against, because GOP's majority isn't big enough to require it.

Yet the Bush administration argument was that terrorists used people couriers and not text messaging and email and telephones to plan attacks thus evading capture… metadata would and is useless to preventing such terrorism. The NSA must be for IRS tax evaders and dissidents.
