He cited Smith v. Maryland, a case whose facts bear almost no resemblance to the metadata program.
Gorsuch recently ripped SvM in a #4thAmendment case.

Donald Trump didn't have to look any further than a judge who is extremely skeptical about checks on presidential power and accountability to the rule of law. He picked the best judge to serve HIS interests, not ours. Kavanaugh forgets justice delayed is justice denied.
