Maya Forstater was working at the Centre for Global Development. She repeatedly expressed the belief that gender isn't important, refused to recognise self-identified gender and that sex is immutable and biological. /1pic.twitter.com/1wbTjpWLuK
She also tweeted transphobic material, by that I mean literally expressing a fear about trans people, especially in the context of protected spaces like toilets or changing rooms. /2pic.twitter.com/AF8OwUuB2E
Crucially, she refused to acknowledge the self-identification of others, including refusing to use their identified gender and pronoun. It was this absolutism that the judge took issue with. /3pic.twitter.com/rgxY3OZAYy
Some of her Twitter content was offensive and staff at her workplace raised concerns. /4pic.twitter.com/A9a59ffrhb
When her contract came up for renewal, she was not re-employed. She subsequently claimed she was terminated due to a protected characteristic, namely a philosophical belief./5pic.twitter.com/EcXKPhhoEW
The judge did not agree her position was a protected "philosophical belief" and that her employer had no obligation to her. Crucially NOT because she stated "sex is real" but because of her denial of others to self-identify their gender and her absolutist expression of this. /6
Which frankly was disrespectful. Reading her material she probably wouldn't have been fired if she had been more conciliatory and respectful in how she expressed her views. Her colleagues found her offensive, and her employer didn't re-employ her. /7
As a doctor, biological sex is important for any number of conditions and genetics: cancer risk, chromosomal disorders, cardiovascular risk etc. No one is denying that. But that IS NOT why Maya Forstater was not re-employed. /8
I think @jk_rowling has misjudged this and needs to read the actual facts of the judgement and re-think if she really does stand with Maya.
I think most reasonable people respectful of the rights of trans people would not. /end
I have been puzzled by this as a case to people are going into bat for. It’s not about the recognition of biological sex as a salient category. I don’t believe JK Rowling thinks it’s right to deny people who have changed sex through operation their change of sex and gender.
