Sounds like another argument for a parliamentary system. If cross-partisan accountability doesn't work, then having parties hold their executives responsible would be a logical alternative. Removing the executive's independent claim to democratic legitimacy would also help.

I’d be interested to see research on different corporate strategies/by-laws for ensuring that directors will conduct robust oversight over a chief executive, rather than become allied. Has anything worked in that realm that we could potentially learn from?

My idea would be that the right locus for such a decision would have to be the Supreme Court, which is tasked with interpreting the Constitution. Partisan as it is, too, it still has more independence from the political process than the legislative branch.

Or something where the Supreme Court is the court, but jurors are high level federal judges that are selected by lot. There is still indirect political control over the body, so you don't just outsource it. Still tricky who can start the process: House or Senate, each, both?
