.@chesaboudin has just denied in whole the records request from @ggreschler for 2.5mo of Boudin's texts, Signals, and more under the "balancing test" (Gov Code 6255). I'm definitely going to shine AS STRONG a light on this as possible. The more he hides the more suspicious I am.

@chesaboudin raises as his defense "burden on law enforcement agency in separating exempt from non-exempt investigative materials". THAT BURDEN IS REQUIRED BY LOCAL LAW (SFAC 67.26). It's why I still get plenty of records of@dennisherrera +@sfpdchief, who also have to do that.Show this thread -
When ppl point out I am unfairly focusing on Boudin - total BD. I've not seen such a response from an agency myself in a long time (if ever?). Other agencies simply tell me they will take a long time based on the volume and then (supposedly) trickle out the records over time.

What Boudin is doing here is almost, but not as, bad as
@LondonBreed just deleting all the texts to begin with... But if Boudin is *auto-deleting* Signal, and thus uses this to delay producing the records until SOTF rules, at which point they are gone, that's no different.Show this thread -
Contrary to what Boudin asks for, there is no requirement to identify records by subject matter instead of just a date range. I've used date ranges for many of my random sampling requests. But Boudin doesn't want random sampling of his texts...
