I think the notion that a baby is going to grow and at some age be responsible to behave withinthe system of rights we have is what grants it. An animal will stay an animal.

Yup, exactly. Maybe the semantic debate isn't the crux of the matter—what's most important is how we treat animals (and how breaching acceptable limits gets encoded into law, whether we're talking about agricultural regulations or how we prosecute animal cruelty).
