Why not just leave this beyond the scope of the school's jurisdiction, let the police figure it out, and then if the school wants to act punitively on the basis of a resultant criminal prosecution, so be it? Or something, I don't know lol.

I think this has to do with an effort to make higher-ed institutions into municipalities of sorts, with undemocratic governmental power. They would, as a collective, become a challenge to freely elected local governments from coast to coast.
