The republicans have left the democrats no choice
The Constitution left it to Congress to decide how many justices should make up the Supreme Court. Over the years, the number has ranged from 6 to 10, before settling at 9. Democrats have the right to expand the court if they think that’s the best way to remedy GOP court packing.

Once upon a time there were 9 appellate districts and 9 justices. Now there are 13 appellate districts so yeah. History is fun.
