Brett Kavanaugh in secret document: “I am not sure that all legal scholars refer to Roe as the settled law of the land at the Supreme Court level since Court can always overrule its precedent, and three current Justices on the Court would do so.”https://nyti.ms/2CrKPfH

cc: @SenatorCollins if you still believe Kavanaugh won’t overrule Roe or severely limit it then you better prepare for your senatorial career post-2020.

I honestly dont understand why it would be a bad thing for the states to vote and decide on the subject of abortion. Why is this so bad? Honest question

B/c that would be the democratic, compromising and Constitutionally correct thing to do.

Either it was or it wasn't. I really would have liked for someone to have brought this issue up in front of his wife and those beautiful daughters of his. Then maybe he would have a definitive answer looking at them in their eyes!

Who voted for Roe v Wade? It was the biggest example of judicial overreach; judges making laws because progressives can't win at the ballot box

Which point? That rulings have gotten overturned throughout history. Plessy v. Ferguson was once law. Now it isn't. What makes Roe v. Wade any different?

If you're going to ask "who voted for school integration," yet don't understand that it took SCOTUS overturning Plessy v. Ferguson to accomplish that, then I can't help you.

If the context wasn't clear, I was responding to the implication that courts can't use judicial review on something that the legislature can conceivably make into a law.
